Based on record review, the licensee did not comply with the section cited above in that the facility did not have documentation of drills completed which poses/posed a potential health, safety or personal rights risk to persons in care.

  101161(a) · Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.

  Eight 3 year old children left the facility at noon which brought the facility back into compliance. Director will stagger the children so they come in at different times, she will keep the capacity at 34 at all times.. Based on observation, the licensee did not comply with the section cited above in that the facility had 43 children in care which is over the capacity by 9 children which poses/posed a potential health, safety or personal rights risk to persons in care.
