Director will complete a retraining with staff for the transitions of shared spaces and provide a copy of training completion to LPA for review. Per LPA observation on 10/14/25 in playground Green finished at 4:15pm and Lilac started at 4:25pm. On 10/16/25 in the art area green finished at 3:25pm and lilac started at 3:33pm. Based on LPA observations green classroom had 18 children in attendance. LPA observed shared space log indicated 16 children in the playground, which was updated to show 18 children at one time which poses a potential health, safety or personal rights risk to persons in care. At 10:31am LPA observed one teacher and four children enter the art room. At 10:33am LPA observed two teachers and eighteen children transition into the garden area/art room. Director and staff will complete: • The CCL on-line videos for all staff/director: Care & Supervision • All STAFF meeting regarding Care and Supervision/personal rights and agenda of discussion & staff sign their names as attending. Based on LPA record reviews and interviews which were conducted and recorded, the preponderance of evidence standard has been met for lack of supervision. CCC self reported the incident to ESCCRO as an UIR on 4/10/25. Director will submit a written action plan regarding playground safety & supervision, i.e. head count, check off sheet of children on the yard when the kids go to the yard and when they are returning to the classroom.

Director will ensure a teacher child ratio of 1:12 visually observing and supervising is followed daily when children are in attendance daily. Director will provide staff for ratios daily when children are in attendance. At 1:02pm LPA observed 17 children supervised by one staff, during resting time in the green room. LPA observed two children to be awake. At 1:08pm LPA observed 13 children supervised by one staff, during resting time in the lilac room. LPA observed one child to be awake.
