102416.5(b)(3)(c)(e) · (b) For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be one of the following:…………(3) More than six and up to eight children, without an additional adult attendant,……..(c) The total licensed capacity for a Small Family Child Care Home shall not exceed eight children. (e) If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). Staff will ensure that they are in compliance with Title 22 regulations regarding staffing ratios in a family child care homes at all times. This requireement was not met as evidenced by: LPA Clayton's observation of one teacher supervising 11 children, and the other teacher had left the property, and returned within 5 minutes, which poses a potential health and safety risk to children in care.
