Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above regarding the above ground pool located in the backyard that did not have a fence that met regulations. The pool was completely filled with water at the time of the inspection and there was no ladder attached. The pool cover was not strong enough to support the weight of an adult and was not locked, which poses an immediate health, safety, or personal rights risk to persons in care.
