102417(g)(9)(A) · Operation of A Family Child Care Home (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. As their age and ability permit, newly enrolled children shall be informed promptly of their duties as required in the plan. (A) Each family child care home shall conduct fire drills and disaster drills at least once every six months.

Deficient Practice Statement Based on interview with Ms. Prisyazhnyuk, the licensee did not comply with the section cited above , and stated she has not conducted a fire drill in over 6 months and does not have the last one documented, which poses/posed a potential health, safety or personal rights risk to persons in care. Staff returned and stayed with C1.Licensee stated that she will train staff and will implement if staff have to leave their respective areas for any reason they will open the curtain so that there can be direct line of site. copy of signed training and new procedure to be sent to LPA by Plan of LPA's Observation of C1 sitting alone on bench eating breakfast and no staff was present in area where C1 was sitting. Per licensee, will complete the Type 'A' Acknowledgment for each child receiving care and submit completed LIC 9224s to LPA via email by due date of 5/5/22. Per Licensee, will remove Olga Smiyan from the daycare immediately. Per licensee will not allow Olga to work or visit daycare during hours of operation. LPA provided LiveScan During tour of facility, at 2:57 p.m., LPA observed Olga Smiyan sitting, providing care and supervision, rocking, one infant. on the floor of the infant nap area. LPA asked Vlad if Olga was fingerprinted and Vlad stated, "No." Vlad stated Olga comes at 12:30 p.m. and stays until 4:00 p.m. to help with nap time and cleaning. This poses an immediate health, safety, and personal rights risk to the children in care. form to licensee. LPA obtained a declaration from licensee.
