102416.5(d)(2) · Staffing Ratio and Capacity (d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either: (2) More than twelve and up to fourteen children only if the criteria in Section 1597.465 of the Health and Safety Code are met.

Deficient Practice Statement Based on observation and record review, the licensee did not comply with the section cited above in there were 14 children present and there was not one at least 6 years old which poses an immediate health, safety or personal rights risk to persons in care. 102416.5(g) · Staffing Ratio and Capacity (g) For the purpose of meeting the criteria in Sections 1597.44 and 1597.465 of the Health and Safety Code, for a school age child who is under age six, the licensee shall maintain documentation verifying the child’s enrollment and attendance at kindergarten, including transitional kindergarten, or elementary school.

Deficient Practice Statement Based on observation and record review, the licensee did not comply with the section cited above in 2 children do not have proof of enrollement and attendance in TK which poses/posed a potential health, safety or personal rights risk to persons in care. 102416.5(e) · If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). Licensee submitted a signed statement saying she is going to adjust her schedule and staffing to accommodate the census and stay in ratio. Moreover, licensee will have a schedule of pick up and drop offs before her assistants leave for the day. (f) The total licensed capacity for a Large Family Child Care Home shall not exceed fourteen children. Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.
