101238(a) · Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.

Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above in that LPA observed various stains on the walls, various boxes and items stacked upon each other on top of the preschool and toddler classroom's cubbies, and toddler rug held various dark stains, which poses/posed a potential health, safety or personal rights risk to persons in care. 101227(a)(1) · All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. All food shall be selected, stored, prepared and served in a safe and healthful manner.

The LPA observed the licensee to have cleaned out the back up freezer. The licensee agrees to continue to monitor and check the food storage, especially in the back up freezer, on a regular bases to ensure things are being the LPA observations, further discussed on the 9099 report. This is a possible risk to the health, safety or personal rights of children in care. properly stored and maintaining temperature. The licensee also agrees to train staff on proper storage, temperatures and requirements in the kitchen.

101215.1(d) · Child Care Center Director Qualifications and Duties (d) The child care center director, or the substitute director as specified in (f) below, shall be on the premises during the hours the center is in operation.

Deficient Practice Statement Based on observation and interview, the licensee did not comply with the section cited above. Upon arrival LPAs met with Staff #1 who stated they was currently the person in charge. Both Director and Assistant Director were not present. LPAs were unable to review Designation of Facility Responsibility (LIC 308) and other documentation to verify that staff #1 is designatined to act on the Director's absence. 101200(c) · (c) The Department has authority to inspect, audit, and copy child and child care center records upon demand during normal business hours. Recrods may be removed if necessary for copying. Removal of records shall be subject to the requirements in Sections 101217(c) and 101221(d).

Staff #1 stated they were are unable to provide LPAs children and staff records due to records being locked in cabinet and only available to Director via key.
