102417(g)(5) · 102417 Operation of a Family Child Care Home (g)(5) - All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence.
Licensee has a scheduled appointment with a pool contractor for 05/06/26 to install an additional portion of gating to make the pool completely inaccessible from all areas of the home. Licensee states she will send analyst photos upon final installation of the fencing, by 05/07/26, to correct the deficiency. Based on analyst observation, the licensee did not comply with the section cited above as home pool, while fenced and inaccessible from facility play yard, can be accessible from windows at the back side of the home where the pool is not fenced which is a potential risk to children in care. Licensee will also make the bedrooms whose windows face the yard inaccessible with locking door handles until the installation of the additional fencing. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department.
