… Fence was fixed today while LPA was present. Director understands that she must check on fence periodcally to make sure planks are attached and fence is in safe condition. Based upon facility interviews with multiple parties, the facility did not fix the broken fence upon notification which poses a potential health, safety and personal rights risk to children in care.

101219(f) · Admission Agreements. The licensee shall comply with all terms and conditions set forth in the admission agreement.

Licensee states that the child was disenrolled by the parent and will be appealing the deficiency. Licensee states conditions of the Admission Agreement are met and will continue to be met. Based on interviews and file reviews, the facility disenrolled Child #1 based on an issue with the child's parent, not an issue with the child. This does not meet the conditions stated in the signed Admission Agreement and is a potential risk to the health and safety of children in care.

Licensee states that she disagrees with the deficiency and that access to the file and requested copies of documents were provided. Licensee will be appealing the citation. Based upon interviews, the facililty, denied the parent access to Child #1's file upon disenrollment. This is a potential risk to the health and safety of children in care.

101700.3(b)(1) · Written Directives per AB2370: A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement is not met as evidenced by Drinking fountains in the 2 classrooms have been capped off. Director has posted signs on all classrooms sinks that have not been tested to not use for drinking or food preperation. Based on water testing results and interviews, facility tested over the Lead Exceedance level at 12 ppb & 11 ppb for 2 classroom drinking fountains. LPA confimred with teachers that the chidlren were using the drinking fountains. This poses an immediate/potential health, safety or personal rights risk to children in care. 101212(d)(1)(C) · Reporting Requirements. Upon the occurrence...of any of the events specified in (d)(1) below, a report shall be made to the Department...Any unusual incident or child absence that threatens the physical or emotional health or safety of any child.

Director has already submitted the incident report and will ensure that any unusual incident that is a threat to the health and safety of children in care will be timely reported to Licensing. The facility did not report a power outage that occurred on 10/28/22, lasting from approximately noon to closing which could pose a threat to the health and safety of children in care should the power outage cause disruption in care or the inability to provide and meet the needs of all children during the outage.

Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above in that the grass/dirt area of the playground is spongy with several various sized holes, disguised by soft dirt and/or leaves, causing a tripping hazard.
