101227(a)(6) · Title 22 Regulation Section 101227(a)(6) (Food Service) states that menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child’s authorized representative.
The facility has already corrected the deficiency by adding a separate vegetarian menu along with the regular food menu. The facility also agrees to submit a letter of understanding regarding the requirement to post menus for all food served and how they will remain in compliance moving forward. Based on review of documentation and observations made during the investigation, the facility failed to post the vegetarian menu as required. Documentation obtained during the investigation confirmed that the vegetarian menu was not posted and available for review by authorized representatives during the time period relevant to the complaint.

101223(a)(3) · (a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal/ unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse/other actions of a punitive nature including but not limited to: interference with Site director stated she will re-train S1 in personal rights. The department is asking for a written plan for S1, and submit to the department no later than POC due date. Once training is completed, facility is asked to submit proof to the department. functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. S1 did not present a safe environment for children, and did not accord children to be free from the above mentioned section 101223(a)(3). S1 was aggressively putting shoes on a child, and dragging another child across the floor. This poses an immediate threat to the health and safety of children in care.

This was not met as evidenced by IMMEDIATE CIVIL PENALTY OF $500 WILL BE ASSESSED Facility Director understands the importance of children's personal rights while in care. Facility director concucted staff training on 11/19/2022 regarding topics of personal righst and positive interactions with parents
Based on observation and interview Facility self reported and provided surveillance video for review which showed staff grab a child by the left arm and lift them up off the floor before placing them into a chair. This ia an immediate health and safety and personal rights risk to children in care Documentation of training/proof of correction was obtained by LPA on 12/06/2022 Office meeting with CCL Management will be scheduled at a later date.
