observation and interview Today, Licensee replaced both play pens with clean play pens. Licensee removed the stained play pens from being accessible. Licensee undertands that the Department should be able to verify that all equipment is in good clean condition upon inspection. Deficiency cleared. LPA Ocegueda observed that there were two mini style play pens located in the hallway being used by infants today which were stained all over. Licensee confirmed the observation. 102423(4) · (4) Personal Rights.To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. Licensee stated she would not use any off-limit bedrooms or areas that were also hazardous for any type of care and supervision or for the use of discipline as this could be intimidating to children in care. Licensee has since purchased cots that children were observed to use today. Top latches were observed on all bedroom doors.
Based on observation and interview, licensee did not comply with the section cited above. LPA observed children sleeping directly on a blanket and area rug causing children to be unconfortable and interfering with their sleep. Interviews revealed that a highly cluttered room is used for children to go to during "time out" for misbehaving. Today, Licensee confirmed that child #1 was inside that room yesterday. This poses a potential risk to the health, safety and or personal rights risks to children in care Today licensee stated she would complete a written statement indicating she understands personal rights. A meeting will be held at the Fresno Regional Office to further address the findings to these allegations. Licensee will submit written statement by POC date 6/21/2023.

Based on observation and interview licensee did not comply with the section cited above. Today, LPA observed an accessible play yard that had access to multiple hazardous items (rusted vehicles, sharp metals, building debris, gasoline cans, a deep trench, wiring, plant pruners) and other items. Per interview of licensee and multiple children, the yard and hazardous area was used as recently as this week. LPA took photos Today licensee placed a lock metal on the gate leading to her side yard which immediately prevented access to the hazardous area where the trench and various materials and objects were. Since the direct side yard also had variuos other hazards, licensee stated she would be removing the broken play equipment, remvove any debris, remove any gardening tools and ensure it was safe before use. This posed and poses an immediate risk to the health, safety and/or personal rights risks of children in care. Licensee plans on making hazardous area inaccessible with gates. Licensee understands that she is not to use the play yard until it is inspected and approved by the Department. Today licensee made the side yard inaccessible by placing a lock. Licensee understands that the deficiency will be cleared once the play yard is remedied of all hazards and gates are placed. 102416.3(a)(6) · Reporting Requirements: Any change from an area of the family child care home previously identified as "off limits" to an area where care and supervision will be provided to children in care. Licensee did not comply with section cited above. Today, LPA observed that children had access to the previously identified off limits kitchen. Interviews revealed that children have had access to two previuosly identified off limit bedrooms and play yard. Licensee placed the baby gate to make the kitchen off limits. Currently the bedrooms all have top safety latches. The play yard was made off limits with a lock today. Licensee will also complete a written statement where she explains her understanding of the requirement pertaining to "off limit rooms" and that children should not be allowed to use areas tha that have not been approved for care. The kitchen floor and counters were cluttered with food jars and other items making it difficult to properly clean and disinfect. LPA reviewed the requirement above and indicated that although the children did not have access to the kitchen, licensee reported she stores and cooks the children's meals in the kitchen, thus should be kept in a clean and orderly condition.
