Deficient Practice Statement Based on interview and record review, the licensee did not comply with the section cited above in that LPA was informed that children in the toddler room under 24 months did not have a documented 15 minute nap time check for the department to review, only start and finish time for children in care which posed a potential health, safety or personal rights risk to persons in care. 101220(a) · Child's Medical Assessments (a) Prior to, or within 30 calendar days following the enrollment of a child, the licensee shall obtain a written medical assessment of the child. This medical assessment enables the licensee to assess whether the center can provide necessary health-related services to the child.

101229.1(b) · Sign In and Sign Out: The person who brings the child to, and removes the child from, the center shall sign the child in/out.

The facility failed to obtain sign in/out signatures from authorized representatives The Director agrees to submit a written plan by 06/02/2023 insuring the Department how the facility will comply with Title 22 regulations in cases where the electronic sign in/out system is unavailable. This poses/posed a potential health, safety or personal rights risk to persons in care.

101223(a)(1) · 101223(a)(1) Personal Rights: a) The licensee shall ensure that each child is accorded the following personal rights (1) To be accorded dignity in his/her personal relationships with staff and other persons.

Facility will complete training on responsibility for care and supervision and personal rights in accordance with CCR Title 22 Division regulations for all teachers. Facility will submit proof of training to the Department by the close of business day, 5/13/2022. Based on staff interviews and video footage review, the facility did not accord dignity to a child in their personal relationships when staff moved a child by dragging them by the arm across the room. This is an immediate health and safety risk to children in care. Facility agrees to provide this report, cited deficiency and other pertinent documents issued by the department to the parent(s) of children in care within 24 hours or the next time in care; this includes all newly enrolled children over the next 12 months.
