101170(e)(2) · All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f) or classroom. Assistant Director (AD) understands that all staff working with children must have a Criminal Record Clearance and be associated to the facility prior to working, residing or volunteering in a licensed facility. Based on the record review & observation, the Licensee did not meet the above regulation which poses an immediate Health, Safety & Personal Rights risk to the children in care. During the facility tour the LPAs observed S1 providing Care & Supervision to children in a preschool Documents reviewed shows S1 has a Criminal Record Clearance. However, S1 was not associated to the facility. AD agrees to submit required documentation to the Department to have S1 associated on or by POC due date of 5-20-2026. Deficient Practice Statement Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above in the LPA observed a staff present and supervising as who was not associated to the facility. During a review of records it was determined the subject staff was employed as of 09/24/2025 and did not have proof of a criminal record clearance which poses an immediate health, safety or personal rights risk to persons in care.
