101223(a)(3) · 101223 Personal Rights(a)The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. The Director stated that she would be retraining staff on personal rights of child specificially on holding or threatening to withhold. The Director stated she will have it done by 11/17/23.

Based on interview, the licensee did not comply with the section cited above. Director statement that Staff #1 was terminated for inappropriate handling of a Facility has taken steps to remedy the situation by suspending and terminating the employment of Staff #1. 101238(a)(1) · (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents.

Director provided proof of regular pest control service and agreed to continue pest control service to eliminate the cock roach issue. Director stated facility has designated staff members who will conduct a walk-through of the facility every evening to ensure facility is clean and any dead cock roaches are cleaned and disposed of. Based on observation and interview, facility did not ensure center was free from cock roaches and clean, safe, and sanitary at all times. Cock roach infestations can cause health hazards. This poses an immediate risk to the health, safety, and personal rights of children in care. Director agreed to work with pest control to find a successful solution that will eliminate this issue. POC to be cleared upon subsequent inspection by POC due date.
