101223(a)(2) · Personal Rights; (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.

Director stated that a staff meeting will be conducted to remind staff of the requirement to wear face coverings and will ask staff to sign an agreement of understanding. Director shall submit copies of the signed agreements to the Department by POC date 02/02/2022. Based on observation and interviews, Licensee did not ensure the personal rights of persons in care to safe and healthful accommodations in that facility staff did not appropriately wear face coverings while in the facility, as described in LIC 9099. This poses a potential risk to the health, safety, or personal rights of children.
