101161(a) · Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation.

Based on interviews with staff and Director that children are enrolled under one license LPA conducted consultation with Director that children when ready to be moved based on thier date of birth will begin the preschool program and make the transition without going back and forth between the infant/toddler and preschool classrooms. are commingled with children from another license. This poses an immeidiate Health and Safety risk to children in care.

101223.2(a) · Any form of discipline or punishment that violates a child's personal rights as specified in Section 101223 shall not be permitted regardless of authorized representative consent or authorization.

based on interviews with Director and staff that Director and LPA agree to have all staff watch a training video that discusses Children's Personal Rights for Child Care that is on the Care Care Licensing website and have them sign off that they completed the training. Director will remove the Toddler chair from the classroom immediately. Toddler chiar with straps was being used with C1 to restrain them from misbehaving and hitting other children, which goes against Personal Rights of children. This poses an immediate Health and Safety risk to children in care. Director will discuss with staff how appropriate forms of discipline with children in their next staff meeting. Director will provide via email the signed forms.

Director has admitted that the facility did not document infant's sleep every 15 minutes although checks were made Deficient Practice Statement Based on interview and record review, the licensee did not comply with the section cited above on six out of 6 toddlers under 24 months which poses a potential health, safety or personal rights risk to persons in care. 101227(7)(b) · Food services In child care centers providing meals to children, the following shall apply (7) Modified diets prescribed by a child's physician as a medical necessity shall be provided. (B) A child shall not be served any food to which the child's record indicates he/she has an allergy. Please modify current allergy chart to specify food preferences or create seperate chart to include one for food allergies and one to include food preferences. Please discard any food that was left behind by prior disenrolled children and continue to discard food as children disenroll from the facility.
