Assistant Rodriguez was not present during today's visit. Licensee stated Ms. Rodriguez does have criminal record clearances and provided analyst with the licensed facility name to complete the fingerprint transfer in office. Based on analyst observation and interview, the licensee did not comply with the section cited above as she had an uncleared assistant, Marlene Rodriguez, working at the facility during analyst's 01/17/25 home visit which poses/posed an immediate health, safety or personal rights risk to children in care. Licensee understands helper will not be allowed to return to assist at the facility until the transfer is completed. Licensee was cited a corresponding civil penalty for the violation. During today's visit, licensee had only seven children in care and confirmed for analyst that two of the previous group of children, who belonged to her helper, Marlene Rodriguez, and were there only on an emergency basis that day. Based on analyst observation, the licensee did not comply with the section cited above as she had 17 children in care during a 01/17/25 home visit. As there were three adults caring for the children and more than adequate supervision being provided at the time, violation was determined to be a potential health, safety or personal rights risk to children in care rather than an immediate one. Licensee provided analyst with a copy of her roster today and states will submit a schedule to analyst of the dates and times the remaining children on her roster attend, by 01/27/25 to provide evidence of no potential future overlap of children in care to correct the deficiency.
