101239(e)(1) · 101239 Fixtures, Furniture, Equipment and Supplies. (e) Faucets used by children for personal care shall deliver hot water. (1) Hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).
Director stated the sink in question will be communicated in writing to both parents and staff that the front sink is off-limits to washing children's hands. Director will review policies to ensure the proper water temperature for the dispenser delivers water temperature of no more than 120 degrees and communicate to staff. Director will submit copies of the new policies to the San Diego Regional office by 2/28/2025. Based on interviews conducted and records reviewed, the licensee did not comply with the above regulation, as Classroom #1 contains a sink with two (2) water dispensing features, including a faucet used by staff and parents to wash children’s hands and one (1) with an instant hot water faucet spout used by staff for children’s personal care, which delivered water in excess of 120 degrees F resulting in an injury to C1, which poses an immediate Health & Safety risk to children in care.

On 11/27/24, upon LPA’s request to label and make hot water spout inaccessible, LPA received a photo of the spout/faucet covered with a red cover and warning sign posted. During facility inspections on 12/05/24 and 2/14/25 LPAs observed the spout/faucet delivering hot water in Classroom #1 to be prominently identified by warning signs. Based on interviews conducted, the licensee did not comply with the above regulation, as a faucet in Classroom #1 delivering hot water in excess of at least, 148 degrees F was not prominently identified by warning signs even though the temperature of the water exceeded 125 degrees F, which poses a potential Health & Safety risk to children in care.
