Licensee stated that she will not provide care to potty trained daycare children until restroom is repaired and inspected. Licensee stated that she will advise LPA once repairs have been completed. 102416.2(b) · 102416.2(b) Reporting requirements. The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home.
Licensee stated that she will fax/mail/email the completed LIC 624B form to the CCL reagrding the restroom incident. Licensee agrees they will watch the Depart. training video about reporting requirements. Based on LPA interviews conducted, Licensee did not comply with the above regulation by not reporting that the daycare restroom was under construction and not available for facility use, which poses a potential health & safety risk to children in care. 102416.5(d)(1) · (d) For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home shall be..(1) Twelve children, no more than four of whom may be infants.
Licensee contacted parents and two children were picked up before LPA concluded visit. LPA provided Licensee with a capacity regulations visual aid and copy of CCR section 102416.5. Based on LPA observations and record review, Licensee did not comply with the above regulation as there were 14 children present, 4 of whom are infants, which poses an immediate health and safety risk to children in care. Licensee stated that she will review capacity and ratio regulations and will provide a written statement to Licensing outlining her understanding of regulations by COB 10/24/2022.

Licensee barricaded stairs before LPA left. Licensee stated that she will be making living room off-limits in the near future, making the stair case inaccessible to children in care. Based on LPA observations, the staircase in the living room is not barricaded, which poses a potential health, safety or personal rights risk to persons in care. LPA advised Licensee to submit an LIC279A and updated LIC999 to reflect the new entrance to daycare, and revised off-limits areas of day care, and that this must be done prior to making changes in facility.

Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan.
