102423(a)(4) · (a)Each child receiving services from a family child care home shall have certain rights...These rights include, but are not limited to, the following: (4)To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other admission child(ren) are sent to the bathroom for timeout. Licensees agree to cease all inappropriate forms of discipline immediately and submit a written a statement of understanding of the Personal Rights regulation. Statement should include acknowledgment of discontinued actions of a punitive nature... Based on the interview, the Licensees did not meet the above regulation which poses an immediate Personal Rights risk to the children in care. During interviews, it was disclosed through the Licensees own self forms of discipline and an outline of how the Licensees plan to implement timeout in the future which should align with Title 22 regulations. Licensee will send a signed/dated copy of the LIC 9224 Acknowledgement of Receipt of Licensing Report to the Department for all children enrolled.

Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan.
