Facility has already addressed visual observation concerns with staff during a staff meeting. During the staff meeting they discussed making sure that staff have visual observation of all children even while signing in or out of a classroom. Based on interview and record review, the facility did not provide visual observation to all children at all times, which poses/posed a potential health, safety, and personal rights risk to persons in care. Deficient Practice Statement Based on LPA observation of School age Classroom and bathrooms, the licensee did not comply with the section cited above. LPA observed dirty walls, dirty floors, dirty furniture and walls needing repair within the classroom. Attached boys and girls bathrooms were observed to have dirty floors, walls, fixtures and a strong odor of urine which poses a potential health, safety or personal rights risk to persons in care. 101170(e)(1) · Criminal Record Clearance. (e) All individuals subject to a criminal record review...shall prior to working, residing or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department... This was not met as evidenced by Director hired Staff 1 and allowed them to work at the facility before checking that they had approved criminal records clearance and association to the facility. A civil penalty of $500 will be assessed. Based on records review, the facility did not comply with the section cited above. Staff 1 did not have criminal record clearance or association to the facility. This poses an immediate health, safety risk to children in care. Director understands the importance of this violation and immediately removed Staff 1 from the facility during time of visit.
