Based on interview, record review, and self report from facility, the licensee did not comply with the section cited above in that an inappropriate action occurred between two children, while there was no staff observing them. Facility agrees to conduct a traning with all staff members regarding personal rights (specifically: appropriate physical interactions with children in care). Facility agrees to submit an agenda and staff sign in sheet for the training conducted to the Department by the POC due date. Based on interview & record review, the facility did not prevent a child in care from being "smacked" on the butt with a toy, multiple times, by a temporary staff member. The "smacks" would not be considered "gentle" and would not be considered "hard" either. This poses/posed a potential health, safety, or personal rights risk to persons in care. Deficient Practice Statement Based on observation the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. LPA observed during the tour in one of the classrooms a mop with cleaning solution attached to it was on the floor in the bathroom and accessbile to the children. 101170(e)(1) · Criminal Record Clearance - All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the Department. Staff was sent home during the inspection. Director agrees to submit a written plan as to how the facility will be and maintain compliance with cited regulation. Plan to be submitted to the Riverside Child Care Regional Office by 3/24/2023.
Based on observation and record review, the facility did not meet the regulation above. Staff without a Criminal Record Clearance/exemption was providing care and supervision to children in care. This poses an immediate risk to the Health, safety, and personal rights to the children in care Please note that there is a $500.00 civil penalty attached to this citation.
