101229(a)(1) · Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. The director contacted the parent within an hour of the incident and notified all center parents the next day. The director has met with the 2 teachers involved and has updated the break procedures so that no teacher is on break during transitions, and reviewed the procedures with all staff. The deficiency is cleared as of 5/8/2026
A child was left unsupervised in restroom for approximately 5 minutes while the rest of the class went to the gym which posed an immediate risk to the Health, Safety or Personal Rights to children in care. Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $1000 per violation and $100 per day until corrected.
