101229(a)(1) · Care and Supervision. No child(ren) shall be left without the supervision, including visual observation, of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1). This regulation was not met by Director Rosalva stated her staff will be provided additional training on “supervision” to prevent similar incidents from reoccurring. Proof of the training shall be submitted to LPA by or before April 12, 2024. On March 19, 2024, a child was unsupervised in classroom (26) for approximately one (1) minute. Based on a record review that was self-reported via an unusual Incident report dated March 25, 2024, facility staff failed to maintain 100% supervision of C1. Facility ordered a safety gate to place inside the entrace of the classroom, conducted training with staff including zoning procedures in classroom to maintain full visibility of all children in the classroom. SS agreed to send log of training with staff signatures to CCL by POC due date 08/04/2023. Based on interview, observation, and record review, facility did not ensure Child #1 was under visual supervision at all times which poses an immediate risk to the health, safety, and personal rights of children in care. SS also agreed to send photos of the gates in the classroom once installed. SS also agreed to have an extra post or barrier installed in the fence next to classroom #4 where there is currently a gap that a small child may be able to fit through.
