102370(d)(1) · (d) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: (1) Obtain a California clearance or a criminal record exemption as required by the Department or Licensee agrees that she will immediately have S2 and S3 fingerprint and Licensee will provide documentation of fingerprint clearance to Community Care Licensing-Fresno Office by 01/12/2024.

Based on observation the licensee did not comply with the section cited above. During the unannounced Case Management-Other (90 Days Visit), LPA observed Staff #2 (S2) and Staff #3 (S3) were providing daycare supervision for six daycare children. Staff #2 stated that Licensee left at 9:30 AM to a private appointment; therefore, S2 and S3 providing care for the daycare children. Both S2 and S3 confirmed that they have provided supervision care to Licensee “whenever she has appointments.” Having an uncleared adults in the daycare home poses an immediate health, safety, or personal rights risk to children in care.
