101661(a) · 6/30/25 - Limitations on Capacity: School Age license has a capacity of 25; 26 children were observed in care. Regulatory requirements for teacher qualifications and ratios were discussed. Technical Support Program (TSP) was discussed, and Licensee agrees to be referred to the TSP. It was discussed that continued violations of regulatory requirements may result in a Non-Compliance meeting or a referral to the Department’s Legal Division for possible administrative action. Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, no deficiencies are cited. A signed copy of this report and appeal rights were provided to Licensee Juan Gama. Deficient Practice Statement Based on record review and observation, the licensee did not comply with the section cited above. During the classroom inspection, LPA observed 26 children present in the classroom with two qualified staff supervising the children. LPA reviewed facility record and observed 26 children check in at the time of the inspection. This poses an immediate health, safety or personal rights risk to persons in care. 101516.5(b)(1) · (a) There shall be a staffing ratio of one teacher and one aide present to every 28 children in attendance. (1) A teacher shall supervise no more than 14 children or with an aide a maximum of 28 children.
Per Site Supervisors, they will provide an updated procedure on how facility will be kept within ratio. Update procedure documentation will be sent to the Fresno Regional office by 06/13/2025. Based on records review, S1 is not a fully qualified teacher as S1 only has 3 ECE Units completed and LPAs’ observed S1 was supervising school age children in the playground without a qualified teacher present. Furthermore, interviewed disclosed that Staff #3 (S3) who did not had ECE units had supervised school age children. These poses a potential health, safety, or personal rights risk to children in care.

101516.2(b) · School-Age Child Care Center Teacher Qualifications and Duties; As an alternative educational prerequisite, a school-age child care teacher may, pursuant to Health and Safety Code Section 1597.21, substitute 20 training hours for each of the required units of education in Section 101216.1. Per Site Supervisors, they will submit proof to CCL-Fresno how school age children will be maintain supervision at all time by qualified staff. 101238.2(d)(1) · 101238.2 Outdoor Activity Space. (d) The surface of the outdoor activity space shall be maintained: (1) In a safe condition for the activities planned.
Based on observation, the sand sensory table has three tiers and each tier have different shape and spaces that have wet sand, dried leaves, and water in the shades of the table. Per Site Supervisor, the sand sensory table and the playground will be monitoring on a daily basis before the children have access to the playground. Site Supervisor will submit proof of correction how the facility staff maintaining the sensory table clean and safe for the children. Per Site Supervisor, the sensory table have sands in it, but during the past few days, it was raining so the table collected water and the dried falling leaves. Per LPA observation, some of the sections of the table have wet sand and dried leaves. The other section of the sensory table has sand, water, and dried leave on it. LPA advised Site Supervisor that the surface of the outdoor activity space and play structure shall be maintained in a safe condition for the activities planned. SUPERVISOR'S NAME: Michael Duarte
