101217(a)(12) · Personnel Records (a) The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Each personnel record shall contain the following information: (12) Tuberculosis test documents as specified in Section 101216(g).

Deficient Practice Statement Based on record review, the licensee did not comply with the section cited above. In reviewing staff records, Staff #1, did not have the required LIC 503/TB records on file. This poses/posed a potential health, safety or personal rights risk to persons in care. 101229.1(b) · Sign In and Sign Out (b) The person who brings the child to, and removes the child from, the center shall sign the child in/out.

101229(a)(1) · Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.

Deficient Practice Statement Based on observation, the licensee did not comply with the section cited above. While LPA was touring the facility, a child was in the restroom, that is located outside of the classroom, in the hallway, while staff #3 was walking back to the classroom. The stall door was also closed and visual supervision was not possible. This poses an immediate health, safety or personal rights risk to persons in care. POC Due Date: 10/12/2023

101170(e) · Criminal Record Clearance (e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility

Staff #4 has a criminal record clearance and is associated to the sister facility in unit #B, however is not associated to this facility.
