Ms. Garcia stated that she will have better communication with staff to let them know who is qualified to provide relief for breaks. Ms. Garcia will submit a statement to the department no later than 4/29/2025. Based on LPA observation, staff Jaclyn Lyberger was observed supervising three toddlers children alone. Ms. Lyberger did not have units in Infant/Toddler on file at the center and is not a qualified teacher which poses/posed a potential health, safety or personal rights risk to children in care.

Director moved C2 back to the infant room after naptime and stated she would call the parent to ask them to wait until a space is available in the infant room. Director will create a letter to the parents recommending a solution, ask them to sign it and send to LPA by 1/30/25. C2 shall remain either in the infant room or on hold until available spot is available. Based upon LPA observation and record review, C2 was enrolled in the toddler component and was not yet 18 months old which is a potential health, safety and personal rights risk to children in care.

Licensee stated, food is now delivered on Fridays for the following week operations, instead of Mondays. Licensee will also provide a written plan of correction to the Department by 11/19/24 regarding how they will ensure there is adequate food supplies to meet children’s needs and menu on a consistent basis. Based on the information obtained during interviews, observations, and documentation reviewed it is determined that there is insufficient menu food to meet day care children’s needs. Children are often unable to have second servings of one or more menu items 2-3 times per week and food supplies frequently run very low by the end of the week, resulting in children being fed whatever is available until the new food shipment arrives which poses/posed a potential health, safety or personal rights risk to children in care.

Licensee removed Ms. Azimi from the faciltiy and the toddler's room was replaced with the Director, while fully qualify preschool staff Patricia Francis stepped in the 2's classroom. Based on LPA observation, staff Safia Azimi was observed supervising the toddlers children alone. Ms. Azimi has has only 3 ECE units on file at the center and is not a qualified teacher which poses/posed a potential health, safety or personal rights risk to children in care. During site visit, toilet paper was present and Director stated wil maintain supplies needed for children. Director stated she will review CDSS Child Care Licensing Providers Resource instructional video: https://ccld.childcarevideos.org/child-care-center-operators/ Children's Personal Rights in Child Care Centers and provide a written summary of the videos to the Department by 11/7/24. Based on the information obtained during interviews it is determined that toilet paper was unavailable to children from 9/26 – 9/31/24 then sporadically afterward for periods of 1-2 days at a time. Staff would use paper towels or wet wipes from other children until supplies were refreshed, which poses an immediate health, safety or personal rights risk to children in care.

Director and staff S1 stated now that they are aware of the regulation they will not allow school agers to remain at the facility anymore. S1's child has already begun school so the situation will not be an issue anymore. Deficiency corrected during cite visit. Based on the information obtained during investigation interviews it is determined that staff S1 brought their school age child to the facility 2-4x per week over the past 2-3 months and remained in the preschool classroom for up to 8 hours which poses a potential health and safety risk to children in care.

Director states she has sent over the transfer previously and the fax did not go through. She resent the request on 8/7 via email to SDIncidentReports@dss.ca.gov and showed LPA the reply email confirming receipt. No further correction is required. Based on interview with Director and a review of Guardian and the Licensing Information System, A+ sub, Coralito "Coral" Garcia has been working for the facility for three weeks without a requested transfer.
